If you do not agree to these Terms, you must immediately discontinue use of the Platform.
1.2 Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion, without prior notice. Modifications become effective immediately upon posting to the Platform. Your continued use of the Platform following any modifications constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically. The "Last Updated" date at the top of this document indicates when these Terms were last revised.
1.3 Additional Terms
Certain features, services, or sections of the Platform may be subject to additional terms and conditions, which will be presented to you at the time of use. Such additional terms are incorporated into these Terms by reference and constitute a binding agreement between you and DRListings.com.
1.4 Binding Arbitration
PLEASE READ SECTION 18 (DISPUTE RESOLUTION) CAREFULLY. It contains an arbitration agreement that requires disputes to be resolved through binding arbitration on an individual basis, and waives your right to a jury trial and to participate in class actions, except where prohibited by law.
2. Eligibility and Account Requirements
2.1 Age Requirement
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. We do not knowingly collect information from individuals under 18 years of age. If we become aware that a user is under 18, we will promptly terminate their account and delete their information.
2.2 Account Registration
Certain features of the Platform require you to register for an account. When registering, you must:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept all responsibility for activities that occur under your account
2.3 Account Types and Roles
The Platform supports different account types with varying permissions and responsibilities:
a) Standard User Accounts:
- Browse and search property listings
- Save favorite properties
- Submit property inquiries
- Participate in forums, blogs, and comments
- Subscribe to newsletters
b) Agent Accounts:
- All standard user privileges
- Create, edit, and manage property listings
- Respond to property inquiries and leads
- Maintain agent profile and contact information
- Access agent dashboard and analytics
- Subject to additional verification requirements
c) Agency Owner Accounts:
- All agent privileges
- Manage agency profile and team members
- View and manage team listings and inquiries
- Access agency-level analytics and reporting
- Subject to business verification requirements
2.4 Account Verification
We reserve the right to verify your identity, credentials, and eligibility at any time. For agent and agency accounts, we may require:
- Government-issued identification
- Professional licenses or certifications
- Business registration documents
- Proof of address
- Additional documentation as reasonably requested
Failure to provide verification when requested may result in account suspension or termination.
2.5 One Account Per User
You may only maintain one active account. Creating multiple accounts for the purpose of circumventing restrictions, manipulating ratings, or any other purpose is strictly prohibited and may result in permanent ban.
2.6 Account Security
You are solely responsible for:
- Maintaining the confidentiality of your password
- All activities occurring under your account
- Ensuring your account credentials are not shared
- Logging out from shared or public computers
We will never ask you for your password via email or phone. Any such request should be reported immediately to our security team.
2.7 Account Termination
We reserve the right to suspend, deactivate, or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Requests from law enforcement or regulatory authorities
- Any conduct we deem harmful to the Platform, other users, or third parties
You may terminate your account at any time through your account settings. Upon termination, your right to use the Platform immediately ceases. We may retain certain information as required by law or for legitimate business purposes.
3. User Conduct and Prohibited Activities
3.1 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for all content you post, transmit, or make available through the Platform.
3.2 Prohibited Conduct
You agree NOT to:
a) Illegal Activities:
- Violate any local, national, or international law or regulation
- Engage in or promote fraudulent, deceptive, or misleading practices
- Infringe upon intellectual property rights of others
- Engage in money laundering, fraud, or any financial crimes
- Facilitate or promote illegal transactions
b) Platform Abuse:
- Attempt to gain unauthorized access to the Platform or related systems
- Interfere with or disrupt the Platform's operation or servers
- Use automated systems (bots, scrapers, crawlers) without written permission
- Reverse engineer, decompile, or disassemble any Platform components
- Bypass security measures or access restrictions
- Create accounts through automated means or under false pretenses
- Manipulate listing rankings, reviews, or engagement metrics
c) Harmful Content:
- Post content that is defamatory, obscene, threatening, or hateful
- Harass, abuse, stalk, or threaten other users
- Post sexually explicit or pornographic content
- Promote violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Post content that exploits or harms minors in any way
- Impersonate any person or entity, or misrepresent affiliation
- Post spam, advertising, or unsolicited commercial content
- Distribute viruses, malware, or other harmful code
d) Listing Misconduct:
- Post fake, fraudulent, or misleading property listings
- Advertise properties you do not have authorization to list
- Misrepresent property details, pricing, availability, or condition
- Post duplicate listings for the same property
- Attempt to circumvent platform fees or payment systems (when applicable)
- Include contact information in listings to avoid platform communication systems
- Post listings for properties not located in covered geographic areas
e) Forum and Community Misconduct:
- Post off-topic, repetitive, or excessive content ("spam")
- Engage in flame wars, personal attacks, or trolling behavior
- Share personal information of others without consent
- Plagiarize content or falsely claim authorship
- Manipulate voting or engagement systems
- Create multiple accounts to manipulate discussions
f) Data and Privacy Violations:
- Harvest, collect, or scrape user data without authorization
- Use Platform data for purposes other than as expressly permitted
- Share, sell, or transfer user data obtained through the Platform
- Create databases or compilations using Platform content
- Contact users for commercial purposes without their consent
3.3 Consequences of Violations
Violation of these prohibitions may result in:
- Removal of offending content
- Warning or formal notice
- Temporary account suspension
- Permanent account termination
- Legal action and pursuit of damages
- Reporting to law enforcement authorities
3.4 Monitoring and Enforcement
While we are not obligated to monitor Platform usage, we reserve the right to:
- Review, monitor, and moderate content and activities
- Remove or modify content that violates these Terms
- Investigate potential violations
- Cooperate with law enforcement
- Take any action we deem necessary to protect the Platform and our users
4. User-Generated Content
4.1 Types of User Content
"User Content" includes all content you submit, post, upload, or transmit through the Platform, including but not limited to:
- Property listings and descriptions
- Photos, videos, and other media
- Forum posts, topics, and replies
- Blog comments and news article comments
- Profile information and biographies
- Reviews and ratings (if applicable)
- Messages and communications
4.2 Content Ownership
You retain ownership of intellectual property rights in content you create and post. However, by posting User Content, you grant DRListings.com a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media formats and through any media channels, now known or hereafter developed, for the purposes of:
- Operating and providing the Platform services
- Promoting and marketing the Platform
- Improving and developing new features
- Creating aggregated and anonymized data
This license survives termination of your account for content that has been shared with or distributed to other users or incorporated into the Platform.
4.3 Content Representations and Warranties
By posting User Content, you represent and warrant that:
- You own or have necessary rights, licenses, and permissions to grant the above license
- Your content does not infringe any intellectual property rights, privacy rights, or other rights of third parties
- Your content complies with these Terms and all applicable laws
- Your content is accurate and not misleading
- You have obtained all necessary permissions, releases, and consents from individuals appearing in your content
4.4 Content Standards
All User Content must:
- Be relevant to the Platform's purpose
- Be truthful, accurate, and not misleading
- Comply with applicable laws and regulations
- Not violate any third-party rights
- Not contain malicious code or harmful materials
- Be in compliance with Section 3.2 (Prohibited Conduct)
4.5 Property Listings - Special Requirements
Property listings must:
- Accurately represent the property being advertised
- Include only properties you are authorized to list
- Contain truthful information about price, features, location, and condition
- Not contain false or misleading photographs
- Comply with fair housing and anti-discrimination laws
- Include all material facts and required disclosures
- Be updated to reflect current availability and pricing
You represent and warrant that you have:
- Authorization from the property owner to list the property
- Rights to use all photos and media included in the listing
- Verified the accuracy of all information provided
- Complied with all applicable real estate regulations
4.6 Content Moderation
We use a post-publication moderation model. Content is published immediately without pre-approval and moderated subsequently. While we strive to review reported content promptly, we:
- Do not pre-screen or approve User Content
- Do not guarantee timely review of all content
- Are not responsible for monitoring all User Content
- May remove content at any time without notice
- May use automated tools to detect prohibited content
The fact that we moderate some content does not mean we review all content or assume liability for User Content.
4.7 Content Removal and Takedown
We reserve the right to remove, edit, or refuse to publish any User Content at our sole discretion, with or without notice, for any reason, including:
- Violation of these Terms
- Copyright or intellectual property infringement
- User complaints or reports
- Legal or regulatory requirements
- Technical or operational reasons
To report infringing or prohibited content, contact us using the procedures outlined in Section 20.
4.8 Backup and Storage
While we implement reasonable backup procedures, we:
- Do not guarantee content preservation or backup
- Are not responsible for loss, corruption, or deletion of User Content
- Recommend you maintain independent backups of important content
- May delete content from inactive accounts after reasonable notice
4.9 Content Retention After Account Termination
Upon account termination:
- Your profile may be deactivated
- Your content may remain published if it has been shared or distributed
- Forum posts and comments may remain visible (possibly as "Anonymous User")
- Property listings created by agents/agencies may be transferred or retained
- We may retain content as required by law or legitimate business purposes
5. Property Listings and Real Estate Services
5.1 Platform Role and Disclaimer
DRListings.com is a technology platform that connects property buyers, sellers, renters, and real estate professionals. WE ARE NOT:
- A licensed real estate broker or agent
- A party to any real estate transaction
- Responsible for the accuracy of listings or property information
- Responsible for the conduct of agents, agencies, or users
- Providing real estate, legal, financial, or tax advice
- Guaranteeing the availability, condition, or price of any property
5.2 No Warranties on Listings
We make no representations or warranties regarding:
- Accuracy, completeness, or reliability of property listings
- Availability of listed properties
- Compliance with local zoning, building codes, or regulations
- Physical condition or legal status of properties
- Accuracy of property valuations or price estimates
- Qualifications or licensing of agents or agencies
- Outcome of any real estate transaction
5.3 Property Information Accuracy
While we encourage accurate listings, we do not:
- Verify property information provided by users
- Inspect properties or confirm conditions
- Validate ownership or authorization to list
- Guarantee current availability or pricing
- Confirm compliance with fair housing laws
It is YOUR responsibility to:
- Conduct your own due diligence
- Verify all property information independently
- Inspect properties before purchase or rental
- Engage qualified professionals (attorneys, inspectors, surveyors)
- Verify agent licensing and credentials
- Understand local real estate laws and regulations
5.4 Third-Party Services and Professionals
The Platform may list, feature, or facilitate connections with third-party real estate professionals, including agents, agencies, lawyers, inspectors, and other service providers. Such listings or connections do NOT constitute:
- An endorsement or recommendation by DRListings.com
- A guarantee of quality, competence, or reliability
- Verification of licenses, credentials, or qualifications
- Establishment of any agency or fiduciary relationship
You are solely responsible for:
- Evaluating and selecting service providers
- Verifying credentials and qualifications
- Negotiating terms and agreements
- Any disputes arising from third-party services
5.5 Agent and Agency Representations
Agents and agencies using the Platform represent and warrant that they:
- Hold all required licenses and registrations
- Are authorized to list properties they advertise
- Comply with all applicable real estate laws and regulations
- Provide accurate and truthful information
- Maintain required insurance and bonding
- Disclose all material facts and conflicts of interest
- Comply with fair housing and anti-discrimination laws
- Maintain client confidentiality and fiduciary duties
Agents and agencies agree to indemnify and hold harmless DRListings.com from any claims arising from their listings, representations, or professional conduct.
5.6 Fair Housing and Anti-Discrimination
All users must comply with fair housing laws and anti-discrimination statutes, including but not limited to:
- The Fair Housing Act (if applicable)
- Local and national anti-discrimination laws
- International human rights conventions
You may not:
- Discriminate based on race, color, religion, national origin, sex, familial status, disability, or other protected characteristics
- Post listings containing discriminatory language or preferences
- Refuse to show properties based on discriminatory criteria
- Apply different terms, conditions, or services based on protected characteristics
Violations will result in immediate account termination and potential legal action.
5.7 Pricing and Fees
Currently, basic use of the Platform is free for users. We reserve the right to:
- Introduce fees for certain features or services
- Charge subscription fees for premium accounts
- Implement transaction-based fees
- Modify fee structures with reasonable notice
When payment features are implemented, additional payment terms will apply. All fees, once charged, are non-refundable unless otherwise stated.
5.8 Lead Generation and Inquiries
The Platform facilitates communication between users and agents/agencies through inquiry forms and messaging systems. We:
- Deliver inquiries on a best-efforts basis
- Do not guarantee response times or quality
- Are not responsible for follow-up or lead management
- Do not guarantee that inquiries will result in transactions
Users acknowledge that:
- Contact information may be shared with agents/agencies
- They may receive follow-up communications
- Inquiries do not create any contractual relationship
- They should only share information they are comfortable disclosing
5.9 Location and Geographic Scope
The Platform primarily focuses on properties in the Dominican Republic. Listings for properties outside our covered areas may be removed without notice.
6. Forum, Blog, and Community Features
6.1 Community Guidelines
Our forum, blog comments, and community features are intended for constructive discussion about real estate, property, and related topics. All community participation must:
- Be respectful and constructive
- Stay on-topic and relevant
- Comply with Section 3 (User Conduct)
- Avoid spam and self-promotion
- Respect others' opinions and experiences
6.2 Forum Rules
When using forum features, you must:
- Choose appropriate categories for topics
- Search for existing discussions before creating duplicates
- Use descriptive topic titles
- Not bump old threads unnecessarily
- Not engage in flame wars or personal attacks
- Not post affiliate links or advertising without permission
6.3 Moderation Discretion
Moderators and administrators have full discretion to:
- Move, edit, merge, or delete posts
- Lock or close discussions
- Issue warnings or temporary bans
- Remove off-topic content
- Enforce community standards
Moderation decisions are final and not subject to appeal, except in cases of clear error.
6.4 No Expectation of Privacy
Community features are public. Content you post can be:
- Viewed by other users and non-users
- Indexed by search engines
- Shared or quoted by others
- Retained even after deletion
Do not post anything you wish to keep private.
6.5 Reporting Violations
Users can report content that violates these Terms. Reports should:
- Be made in good faith
- Provide specific details
- Not be used to harass or silence others
- Not be made maliciously or frivolously
False reports may result in account penalties.
7. Intellectual Property Rights
7.1 Platform Ownership
The Platform and all its contents, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, audio clips, video, data compilations, software, and the selection and arrangement thereof) are owned by DRListings.com, its licensors, or other content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Trademarks
"DRListings," "DRListings.com," our logos, and other marks used on the Platform are trademarks or registered trademarks of DRListings.com. You may not use these marks without our prior written permission. Other trademarks, service marks, and trade names that appear on the Platform are the property of their respective owners.
7.3 Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Platform for personal, non-commercial purposes
- View and download content for personal use only
- Use features and functionality as intended
This license does not include any right to:
- Modify, copy, reproduce, or distribute Platform content (except User Content you own)
- Use the Platform for commercial purposes without authorization
- Reverse engineer or extract source code
- Remove or modify copyright notices or proprietary markings
- Create derivative works
7.4 User Submissions and Feedback
Any feedback, suggestions, ideas, or other information you provide about the Platform ("Feedback") becomes our property. You assign all rights, title, and interest in such Feedback to us, and we may use it for any purpose without compensation or attribution to you.

8.2 Communications
By creating an account, you consent to receive:

- Marketing communications (with opt-out option)
- Push notifications (if enabled)
- SMS messages (if you provide phone number)
You may opt out of marketing communications at any time using the unsubscribe link or account settings.
8.3 Data Security

- Accuracy or reliability of third-party information
- Products or services offered by third parties
- Transactions conducted with third parties
9.3 User Responsibility
You access third-party links at your own risk. You should:
- Review their terms and privacy policies
- Exercise caution when providing information
- Make your own independent judgments
- Report suspicious or fraudulent sites to us
10. Payment Terms (Future Implementation)
10.1 Payment Services
When payment features are implemented, this section will govern all transactions. By using payment services, you agree to:

10.2 Fees and Charges

THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
11.2 Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, DRLISTINGS.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY: No warranty that the Platform is fit for any particular purpose or will meet your requirements.
- FITNESS FOR PARTICULAR PURPOSE: No warranty that the Platform or any content is suitable for real estate transactions, investment decisions, or any specific use.
- NON-INFRINGEMENT: No warranty that use of the Platform will not infringe third-party rights.
- ACCURACY: No warranty regarding the accuracy, completeness, reliability, or timeliness of property listings, user-generated content, pricing, agent credentials, or forum discussions.
- AVAILABILITY: No warranty that the Platform will be uninterrupted, timely, error-free, or compatible with all devices.
- RESULTS: No warranty that use of the Platform will lead to property transactions or that listings will receive inquiries.
11.3 No Professional Advice
The Platform does not provide and is not a substitute for:
- Professional real estate advice or representation
- Legal counsel or advice
- Financial, tax, or investment advice
- Property inspection or appraisal services
- Architectural, engineering, or construction advice
Always consult qualified professionals for these services.
11.4 User Responsibility
You are solely responsible for:
- Your use of the Platform and reliance on any content
- Verifying all information independently
- Conducting due diligence on properties, agents, and services
- Your interactions and transactions with other users
- Protecting your account credentials and device
- Backing up any important data or content
11.5 Currency Conversion Disclaimer
The currency conversion feature on this Platform is provided for informational and convenience purposes only. Exchange rates displayed are estimates that are updated approximately once per week and may not reflect current market rates at the time of your transaction.
Important:
- All property prices are listed in their original currency (typically USD) and converted prices are approximations only.
- Actual exchange rates at the time of purchase or transaction may differ significantly from the rates displayed on this Platform.
- We do not guarantee the accuracy, completeness, or timeliness of any currency conversion information.
- You should consult with your bank, financial institution, or a qualified financial advisor to obtain accurate exchange rates before making any financial decisions.
- DRListings is not responsible for any financial loss or inconvenience arising from reliance on the currency conversion feature.
The currency conversion feature does not constitute financial advice. By using this feature, you acknowledge and accept these limitations.
12. Limitation of Liability
12.1 No Indirect or Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DRLISTINGS.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Loss of goodwill or reputation
- Business interruption
- Property damage or personal injury
- Failed real estate transactions
- Investment losses
- Cost of substitute services
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.
12.2 Cap on Direct Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
- Fees you paid to DRListings.com in the twelve (12) months preceding the claim, or
- One hundred US dollars (USD $100)
12.3 User Responsibility
Your sole and exclusive remedy for dissatisfaction with the Platform is to stop using it. You assume full responsibility for:
- Your use of the Platform
- Decisions made based on Platform content
- Transactions or communications with other users
- Verifying information independently
13. Indemnification
13.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless DRListings.com, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and service providers (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising from or related to:
a) Your Use of the Platform:
- Your access to or use of the Platform
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights
b) Your Content:
- Any User Content you post, upload, or transmit
- Infringement of intellectual property rights through your content
- Defamatory, misleading, or illegal content you provide
c) Your Conduct:
- Your interactions with other users
- Your real estate transactions or dealings
- Fraudulent, deceptive, or misleading practices
- Harassment, threats, or abuse of others
d) Your Listings:
- Inaccurate, fraudulent, or misleading property listings
- Unauthorized listing of properties
- Violations of fair housing or anti-discrimination laws
- Property condition misrepresentations
13.2 Survival
Your indemnification obligations survive termination of these Terms and your use of the Platform.
14. Modification and Termination of Services
14.1 Right to Modify Platform
We reserve the right at any time to:
- Modify, suspend, or discontinue any aspect of the Platform
- Add, remove, or change features or functionality
- Change availability of content or services
- Implement usage limits or restrictions
- Update software, systems, or infrastructure
Such modifications may be made with or without notice, at our sole discretion.
14.2 No Liability for Modifications
We shall not be liable to you or any third party for:
- Modification, suspension, or discontinuation of services
- Removal or unavailability of features
- Loss of data resulting from modifications
- Compatibility issues with updates

Upon termination:
- Your access rights immediately cease
- We may delete your account data (subject to retention requirements)
- Certain User Content may remain published
- Your license to use the Platform is revoked
14.4 Termination by Us
We may terminate or suspend your access immediately, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse of the Platform or other users
- Extended inactivity
- Risk to Platform security or integrity
- Legal or regulatory requirements
15. DMCA and Copyright Policy
15.1 Respect for Copyright
We respect the intellectual property rights of others and expect users to do the same. We respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.
15.2 Filing a DMCA Notice
If you believe your copyrighted work has been copied and posted on the Platform in a way that constitutes copyright infringement, please provide our Copyright Agent with written notice containing:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing, with information reasonably sufficient to locate the material on the Platform (e.g., specific URLs)
- Your contact information: name, address, telephone number, and email address
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

15.3 Repeat Infringer Policy
We maintain a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers. An account may be terminated after multiple valid DMCA takedown notices or demonstrated pattern of infringing behavior.

This procedure applies specifically to copyright. For other intellectual property concerns (trademarks, patents, trade secrets), contact legal@drlistings.com with details of your claim.
16. Export Controls and Sanctions
16.1 Compliance with Export Laws
You agree to comply with all applicable export and import control laws and regulations, including:
- United States export control laws and regulations
- European Union export control regulations
- Dominican Republic export and import laws
- International sanctions and embargoes
- Trade restrictions imposed by any government
16.2 User Representations
By using the Platform, you represent and warrant that:
- You are not located in a restricted jurisdiction
- You are not on any prohibited parties list
- You will not use the Platform in violation of export control laws
- You will not provide access to the Platform to prohibited parties

18. Dispute Resolution and Arbitration
18.1 Informal Dispute Resolution
Before initiating formal proceedings, you agree to first contact us to seek informal resolution. Send a detailed written description of the dispute to legal@drlistings.com. We will attempt to resolve the dispute informally within 60 days.
18.2 Binding Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform (collectively, "Disputes") will be resolved through binding arbitration rather than in court, except as provided below.
18.3 Class Action Waiver
YOU AND DRLISTINGS.COM AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY.
You waive any right to:
- Participate in a class action lawsuit
- Join claims with other users in a consolidated proceeding
- Pursue claims as a class representative or class member
- Participate in mass arbitration or collective arbitration
Each party may bring claims only in their individual capacity.
18.4 Jury Trial Waiver
YOU AND DRLISTINGS.COM WAIVE ANY RIGHT TO A JURY TRIAL for any dispute subject to arbitration.
18.5 Exceptions to Arbitration
The following disputes are NOT subject to arbitration:
- Claims for injunctive or equitable relief to protect intellectual property rights
- Small claims court actions (if within jurisdiction limits and on individual basis)
- Claims that cannot be arbitrated under applicable law
18.6 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to legal@drlistings.com within 30 days of first accepting these Terms. The notice must include:
- Your name, email address, and account information
- Clear statement that you opt out of the arbitration agreement
- Your signature (physical or electronic)
If you opt out, all other Terms still apply, but disputes will be resolved in court per Section 18.7.
18.7 Governing Law and Jurisdiction (If Not Arbitrated)
For disputes not subject to arbitration:
- Governing Law: These Terms are governed by the laws of the Dominican Republic, without regard to conflict of law principles.
- Jurisdiction: You agree to the exclusive jurisdiction of the courts located in Santo Domingo, Dominican Republic.
18.8 Statute of Limitations
Regardless of any statute or law to the contrary, any claim or cause of action arising from or related to use of the Platform or these Terms must be filed within one (1) year after the claim or cause of action arose, or be forever barred.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and DRListings.com regarding the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:
- That provision shall be modified to reflect the parties' intention to the maximum extent permitted by law
- If modification is not possible, the provision shall be severed
- All other provisions remain in full force and effect
19.3 No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision, any other rights or provisions, or future enforcement. Any waiver must be in writing and signed by an authorized representative of DRListings.com.
19.4 Assignment
You may not assign, transfer, or delegate these Terms or your rights/obligations without our prior written consent. We may assign these Terms without restriction, including to affiliated companies, successor entities in merger or acquisition, or third parties in asset sale.
19.5 Force Majeure
We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including:
- Acts of God, natural disasters
- War, terrorism, riots, civil unrest
- Government orders or regulations
- Strikes, labor disputes
- Internet, telecommunications, or power failures
- Pandemics or public health emergencies
19.6 Electronic Communications
By using the Platform, you consent to receive communications from us electronically. You agree that electronic communications satisfy any legal requirements that communications be in writing.
19.7 Notice Requirements
Notices to You: We may provide notices through email to your registered email address, posted notices on the Platform, in-app notifications, or other reasonable means.
Notices to Us: All legal notices to DRListings.com must be sent to legal@drlistings.com. Notices should be marked "Attention: Legal Department."

- You will comply with all applicable laws and regulations
- You understand the disclaimers, limitations of liability, and arbitration provisions

- If using the Platform on behalf of an organization, you have authority to bind that organization
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE PLATFORM.
22. Specific Provisions for Professional Users
22.1 Real Estate Agents
Agents using the Platform additionally agree to:
- Maintain all required professional licenses in good standing
- Comply with local real estate commission rules and regulations
- Adhere to applicable codes of ethics (e.g., NAR Code of Ethics)
- Maintain required errors and omissions insurance
- Disclose agency relationships and conflicts of interest
- Provide accurate and honest representations
- Respond to inquiries in a timely and professional manner
- Keep client information confidential
- Not engage in unauthorized practice of law or provide legal advice
22.2 Agency Owners
Agency owners additionally agree to:
- Ensure all team members comply with these Terms
- Maintain proper supervision of affiliated agents
- Verify licenses and credentials of team members
- Maintain adequate insurance coverage
- Accept responsibility for actions of agents under their agency
- Promptly address complaints or disputes involving team members
22.3 Professional Liability
Agents and agencies acknowledge that:
- They are solely responsible for their professional conduct
- DRListings.com has no liability for their professional actions or omissions
- They must maintain their own professional liability insurance
- They indemnify DRListings.com for claims arising from their professional services
22.4 Commission Disputes
DRListings.com is not involved in and has no liability for:
- Commission disputes between agents, agencies, or clients
- Payment disputes arising from real estate transactions
- Conflicts over client representation or procuring cause
- Any financial arrangements between users
23. Special Terms for Dominican Republic Operations
23.1 Local Law Compliance
All users in the Dominican Republic must comply with:
- Ley No. 108-05 de Registro Inmobiliario (Real Estate Registry Law)
- Local municipal regulations and zoning laws
- Dominican consumer protection laws (Ley 358-05)
- Data protection and privacy regulations
- Tax and financial reporting requirements
23.2 Property Documentation
Listings for Dominican Republic properties should include:
- Accurate property identification (parcel numbers where available)
- Truthful information about title status
- Disclosure of encumbrances, liens, or restrictions
- Honest representation of legal status (condominium, freehold, etc.)
23.3 Currency and Pricing
- Prices may be displayed in multiple currencies for convenience
- All currency conversions are estimates only
- Actual transaction currency and price are determined by parties to the transaction
- We are not responsible for exchange rate fluctuations
23.4 Language
The Platform supports multiple languages. While we strive for accurate translations:
- Translations are provided for convenience only
- The English version of these Terms is authoritative
- Users are responsible for understanding Terms in their language
- Professional translation services should be used for legal documents
23.5 Dominican Republic Consumer Rights
Nothing in these Terms limits statutory consumer rights available under Dominican Republic law. If you are a consumer in the Dominican Republic, you may have additional non-waivable rights under local consumer protection laws.
